Last updated: July 21st, 2026. Please read these Terms of Service (“Terms”) carefully before using Semaa House’s website (“Site”) or placing an order.
1. Acceptance of Terms
By accessing or using this Site, browsing our products, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Site.
2. Eligibility & Age Requirement
- Minimum age: You must be at least 19 years of age to access this Site, purchase products, or create an account. By using this Site, you represent and warrant that you meet this age requirement.
- Legal capacity: You must be able to form a legally binding contract to use this Site.
- Age verification: We reserve the right to request proof of age at any point before, during, or after checkout, as described in our Age Verification Policy. We may refuse or cancel any order where age cannot be verified.
3. Indigenous-Owned Business
- Our status: [Business Name] is owned and operated by a member/members of Chippewas of the Thames First Nation, and operates from the Chippewas of the Thames First Nation reserve, Ontario.
- Our position: We conduct business in accordance with the Aboriginal and treaty rights recognized and affirmed under Section 35 of the Constitution Act, 1982, and, where applicable, the specific treaty and inherent rights held by Chippewas of the Thames First Nation. It is our position that these rights include the right to manufacture, sell, and trade tobacco and related products.
- Assumption regarding purchasers: We assume that individuals purchasing from us are doing so in a personal capacity and do not undertake to investigate, verify, or confirm a purchaser’s Indigenous status, band membership, or ancestry. We do not assert any right to inquire into a purchaser’s lineage or status, and place no such requirement on you as a condition of sale, beyond the age-verification requirements described elsewhere in these Terms.
- Legal complexity: We recognize that the scope of these rights — including how they apply to sales made to customers located off-reserve or in other provinces — is a complex and, in some respects, unsettled area of law, and that federal and provincial governments may take differing positions on this issue.
- Customer responsibility: By placing an order, you acknowledge that you are responsible for understanding and complying with any tax, licensing, or import laws that apply in your own province or territory of residence. [Business Name] makes no representation as to how these rights or any related tax treatment apply to your specific purchase or location.
4. Products
- Product availability: All products are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse any order at our discretion.
- Product descriptions: We make reasonable efforts to ensure product descriptions, images, and pricing are accurate, but we do not warrant that this information is complete, current, or error-free.
- Pricing errors: In the event a product is listed at an incorrect price due to typographical or technical error, we reserve the right to cancel the order and refund any payment received.
5. Orders & Payment
- Payment method: We currently accept Interac e-Transfer only, as described in our Payment Policy. Orders are not confirmed or processed until payment has been received and verified.
- Order acceptance: Your order is an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspected fraud, unverifiable age, or unavailability of product.
- Cancellations: Unpaid orders may be cancelled if payment is not received within the timeframe specified in our Payment Policy.
6. Shipping
Shipping is handled in accordance with our Shipping Policy, including carrier selection (Canada Post, with FedEx as a contingency), delivery timelines, shipping costs, and our process for lost or damaged packages. We currently ship within Canada only.
7. Returns & Refunds
All sales are final. Refunds are only issued under special circumstances as outlined in our Payment Policy, including confirmed lost or damaged shipments or order errors on our part. Refund requests are reviewed on a case-by-case basis.
8. Prohibited Uses
You agree not to:
- Use this Site for any unlawful purpose or in violation of any applicable federal, provincial, or local law;

This Site and all products are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, secure, or error-free.
11. Limitation of Liability

Disclaimer: This document is a starting template, not legal advice. Terms of Service for age-restricted retail (particularly tobacco/vape products) are subject to federal and provincial regulation. This is especially true of Section 3 (Indigenous-Owned Business): the scope of Aboriginal and treaty rights as they apply to tobacco sales — particularly to off-reserve and out-of-province customers, and where the seller does not verify purchaser status — is a genuinely complex and contested legal area, and positions can vary significantly by First Nation, treaty, and province. The clause stating that you do not verify purchaser status is a meaningful legal choice, not just a courtesy statement, and its effect should be reviewed specifically. Please have this document reviewed by a lawyer experienced in both retail/tobacco law and Indigenous commercial law — ideally one familiar with Chippewas of the Thames First Nation and Ontario tobacco regulation specifically — before publishing.
